Please read these Event Terms and Conditions carefully. By purchasing, receiving, holding or using a Ticket, entering the Event Site, or attending the Event, you agree to be bound by these terms and to comply with all reasonable directions of the Promoter, the Venue and Event Staff.
1. Definitions
Authorised Ticketing Agency means Flicket Ltd and any other ticket seller expressly approved in writing by the Promoter.
Event means AFROSOUL Brisbane 2026 scheduled for Sunday, 11 October 2026 at the Venue, including all performances, activations, hospitality areas and related activities.
Event Information means information published by the Promoter, Flicket or the Venue about the Event, including the Flicket Event page, ticket description, patron guide, FAQs, maps, accessibility information and official Event communications.
Event Site means the parts of Eatons Hill Hotel designated for the Event, including entry areas, The Green or other performance areas, bars, amenities, queues, car parks and any controlled access areas.
Event Staff means the Promoter, Venue management, security personnel, contractors, volunteers, medical personnel, police and other authorised representatives working at the Event.
Flicket means Flicket Ltd, the authorised ticketing agency for the Event.
Promoter means Audiology Touring Ltd.
Ticket means a valid ticket, pass, credential or wristband issued or approved by the Promoter or Flicket for the Event.
Ticket Holder means the person possessing or using a Ticket, including the original purchaser and any lawful transferee.
Venue means Eatons Hill Hotel, 646 South Pine Road, Eatons Hill, Queensland 4037.
2. Binding terms and order of application
These Event Terms and Conditions apply in addition to Flicket’s ticketing terms, the Venue’s conditions of entry, the conditions printed on or supplied with a Ticket, and any Event-specific directions published by the Promoter.
Each set of terms applies to its relevant subject matter. Flicket’s terms principally govern the ticket transaction and ticketing platform. These terms principally govern the Event, entry and attendance. The Venue’s conditions govern conduct and access on Venue property.
If an Event-specific written instruction issued by the Promoter conflicts with a general provision in these terms, the Event-specific instruction applies to the extent of the inconsistency, subject always to applicable law.
The original purchaser must make these terms available to each person for whom they purchase or transfer a Ticket. Each Ticket Holder is independently bound by these terms.
3. Event details and official information
The Event date, advertised venue, age classification, ticket type, gates time and other key details are those stated on the Flicket Event page and Ticket, as updated by an official Event communication.
Performance times and running orders are estimates and may change. Gates opening time is not the same as the time the first artist will perform.
Ticket Holders are responsible for checking the Flicket Event page, the Event’s official website and social channels, and communications sent to the purchaser before travelling to the Venue.
Information published by an artist, reseller, social media user or other third party is not an official Event communication unless the Promoter confirms it.
4. Waitlists, registrations and presales
Joining a waitlist, registering for updates, receiving a presale code or entering a ticket queue does not guarantee access to a presale, the ability to purchase a Ticket, a particular ticket category or a particular price.
Presale codes are personal or limited-use where stated and must not be sold, published, shared commercially or used contrary to the conditions of issue.
The Promoter and Flicket may cancel or restrict access obtained through misuse of a presale code, automated purchasing process or other unfair purchasing method.
5. Ticket purchases and purchaser information
Tickets must be purchased through Flicket or another Authorised Ticketing Agency. Tickets obtained elsewhere are purchased at the Ticket Holder’s own risk and may be invalid, duplicated, cancelled or fraudulent.
The purchaser must provide complete and accurate contact, billing and attendee information and must keep that information current. The Promoter and Flicket are not responsible for a missed notice caused by incorrect, incomplete or outdated details.
The purchaser must be authorised to use the selected payment method and to provide any personal information entered for another attendee.
A ticket transaction is not complete until payment has been successfully processed and Flicket has issued an order confirmation or Ticket.
6. Ticket limits, bots and unfair purchasing
The Promoter may set ticket purchase limits by person, household, account, email address, payment method, billing address, device or transaction.
The Promoter or Flicket may cancel all or part of an order where it reasonably appears that a purchase limit has been exceeded or multiple connected orders have been used to avoid a limit.
The use of bots, scripts, automated purchasing tools, false identities or other methods designed to obtain an unfair advantage is prohibited.
Tickets obtained through prohibited methods may be cancelled and refunded at face value, less any amount lawfully retained, or otherwise dealt with in accordance with applicable law.
7. Prices, fees and genuine errors
Ticket prices and applicable fees are displayed by Flicket before purchase. Prices may vary between ticket categories, release periods and packages.
Where a price, ticket category, availability statement or package description contains an obvious and genuine error, the Promoter or Flicket may correct the error and either offer the purchaser the correct transaction or cancel the affected transaction and provide a refund.
Nothing in this clause permits the Promoter or Flicket to avoid obligations under the Australian Consumer Law.
8. Ticket delivery, barcodes and admission
Entry requires a valid Ticket issued by Flicket or another Authorised Ticketing Agency. A Ticket may be presented on a mobile device or in another approved format.
Each barcode permits one admission only. If duplicate copies exist, the first valid barcode scanned may be admitted and later copies may be refused.
The Promoter, Flicket or Venue may require proof of purchase, identification, the original payment method or other reasonable verification information.
Defaced, altered, copied, unreadable or suspected fraudulent Tickets may be refused. The Ticket Holder is responsible for keeping the Ticket and barcode secure.
Lost, stolen, damaged or destroyed Tickets will be handled under Flicket’s procedures and the Venue’s conditions. Replacement is not guaranteed.
9. Ticket transfers and name changes
A Ticket may only be transferred or renamed through a process approved by the Promoter or Flicket. A fee may apply.
Once a Ticket has been validly transferred or renamed, the previous holder has no right to use, reclaim or control that Ticket.
The Promoter may restrict transfers for particular ticket categories, complimentary tickets, accessible tickets, VIP packages or fraud prevention purposes.
The person receiving a transferred Ticket is bound by these terms.
10. Resale and prohibited commercial use
A Ticket must not, without the Promoter’s prior written consent, be:
resold or offered for resale contrary to applicable law or above any price limit specified by the Promoter;
listed on an unauthorised resale platform;
used in advertising, promotions, competitions, trade promotions or hospitality packages;
bundled with goods or services for commercial gain; or
used to enhance demand for another product, service or event.
A Ticket used in breach of this clause may be cancelled and the Ticket Holder may be refused entry, subject to applicable law. The Promoter and Venue are not responsible for losses arising from unauthorised resale or a fraudulent Ticket.
11. Chargebacks and payment disputes
Purchasers should contact Flicket promptly to resolve a ticketing or payment concern before initiating a chargeback, where reasonably practicable.
A chargeback or payment reversal made without a valid basis may result in cancellation of the affected Tickets and recovery of reasonable costs, subject to applicable law.
This clause does not limit a purchaser’s lawful right to dispute an unauthorised or incorrectly processed transaction.
12. Refunds and change of mind
Tickets are not refundable or exchangeable because of a change of mind, personal circumstances, illness, travel disruption, transport difficulties, failure to attend, failure to arrive on time or failure to comply with the published entry requirements, except where required by law.
No refund is payable for any unused part of a Ticket where a Ticket Holder voluntarily leaves, arrives late, is refused entry or is removed because of their own conduct or breach of these terms, except where required by law.
Complimentary or free Tickets have no cash value. If the Event is cancelled or rescheduled, the holder of a complimentary Ticket may be offered a replacement ticket but is not entitled to a cash refund.
13. Cancellation, postponement, rescheduling and relocation
The Promoter may cancel, postpone, reschedule or relocate the Event where reasonably necessary.
If the Event is rescheduled or relocated, existing Tickets will remain valid unless the Promoter advises otherwise.
Where a refund right applies, the Promoter or Flicket will announce the refund process and a reasonable application period. Approved refunds will be processed through Flicket, generally to the original payment method.
Refunds will include the amounts required by law. The treatment of booking, transaction, delivery, payment and other fees will be determined in accordance with applicable law and Flicket’s terms.
Except where recoverable under applicable law, the Promoter, Flicket and Venue are not responsible for travel, accommodation, meals, transport, loss of income or other expenses incurred in connection with the Event.
Covid-19: The parties acknowledge that, as at the time of purchase, there is a respiratory outbreak caused by Covid-19 that is impacting Australia. The parties agree that where it is impossible or impractical for the performances to take place due to any cause or event in connection with Covid-19 pandemic that is not reasonably within the control of the promoter, then the Performance will be cancelled and the parties will have no further liability to each other, the ticket purchaser will be refunded any monies paid to the promoter less any booking fees paid to the ticket agent and credit card fees paid to the ticket purchasers bank.
14. Artists, lineup, program and performance changes
A Ticket is purchased for admission to the Event as a whole and not solely for a particular artist, performer, attraction, stage, set time or duration.
The Promoter may make reasonable changes to the lineup, support acts, performance order, set times, stages, production, attractions, activities and Event program.
A change to a support act, set time, performance length or individual program element does not automatically entitle a Ticket Holder to a refund where the Event otherwise proceeds substantially as advertised.
Nothing in this clause limits rights under the Australian Consumer Law where a cancellation or major change makes the Event materially different from what was purchased.
15. Circumstances outside reasonable control
The Event may be affected by circumstances outside the Promoter’s reasonable control, including extreme weather, natural disaster, fire, flood, public health emergency, government direction, war, civil disturbance, terrorism, security threat, industrial action, transport disruption, utility failure, venue closure, artist illness or injury, border restrictions or major travel disruption.
The Promoter may delay, suspend, modify, relocate, reschedule or cancel the Event where reasonably necessary because of such circumstances.
Any refund, credit or other remedy will be determined in accordance with applicable law and the circumstances of the Event.
16. Age classification, minors and identification
The Event age classification is the classification stated on the Flicket Event page and Ticket. That classification forms part of these terms.
If the Event is classified as all ages, every person under 18 must hold a valid Ticket and remain accompanied by a ticket-holding parent or legal guardian at all times. Minors must not approach licensed bars or purchase, possess or consume alcohol.
If the Event is classified as 18+, a person under 18 will not be admitted.
The Venue may require identification to enter the Venue, verify age or purchase alcohol. Accepted identification includes a valid Queensland driver licence, a valid Australian or international passport, a valid Australian proof-of-age card, or a Queensland Digital ID displayed live through the official app. Screenshots of digital identification are not accepted.
A person who cannot provide acceptable identification when requested may be refused entry or alcohol service. No refund is payable where refusal results from failure to satisfy a clearly published age or identification condition, except where required by law.
Due to noise levels, crowd density and the nature of a live festival environment, the Promoter and Venue do not recommend bringing babies or very young children.
17. Conditions of entry and security screening
Entry is subject to security screening and any reasonable search of a Ticket Holder and their possessions.
A person who refuses a reasonable search may be refused entry without refund, except where required by law.
Event Staff may inspect bags, use metal detection or other lawful screening methods, and require a prohibited item to be surrendered, removed from the Event Site or otherwise dealt with in accordance with law and Venue procedures.
The Promoter and Venue are not responsible for prohibited items surrendered, abandoned or confiscated, to the extent permitted by law.
Ticket Holders must remain on designated paths and within authorised areas and must comply with emergency, evacuation and safety directions.
18. Bags and prohibited items
Bags larger than A4 size and backpacks are prohibited. There are no lockers or bag-holding facilities.
Prohibited items include, without limitation:
weapons, knives, metal cutlery or objects capable of being used as weapons or missiles;
explosives, fireworks, flares, sparklers, fuels, flammable liquids, open flames or fire-twirling equipment;
illegal drugs, drug paraphernalia, nitrous oxide bulbs or canisters;
glass items, including bottles, jars, mirrors and perfume bottles;
outside alcohol, soft drinks and other beverages, except sealed bottled water and approved medical items as permitted under clause 25;
chairs, tables, tents, sun shelters, umbrellas, prams, carts, wagons, beach trolleys, eskies or coolers;
poles, sticks, selfie sticks, tripods, monopods, large flashlights, kites or sky lanterns;
drones, remote-control devices, laser pointers or portable laser equipment;
air horns, whistles, loudhailers, unauthorised sound systems or musical instruments;
large banners, oversized flags, unauthorised signs or items that obstruct sightlines;
professional cameras, detachable lenses, video cameras, audio recording devices, GoPro-type devices or commercial recording equipment without accreditation;
paint, markers, paint pens, spray cans, unauthorised stickers, flyers, samples or promotional materials;
skateboards, scooters, bicycles, rollerblades, hoverboards, Segways or other personal transport devices;
animals other than assistance animals permitted under clause 27; and
any other item reasonably considered by Event Staff to be dangerous, offensive, disruptive or inappropriate for the Event.
The Promoter may publish additional or revised prohibited-item requirements before the Event where reasonably necessary for safety, security, licensing or Venue operations.
19. Wristbands and credentials
The Promoter may issue wristbands, lanyards or other credentials for entry or access to particular areas.
A credential must be worn or displayed as directed and must not be removed, transferred, altered or tampered with.
A removed, damaged, transferred or tampered credential may be invalidated and may not be replaced.
Restricted-area credentials do not guarantee access where an area has reached capacity or access is suspended for safety or operational reasons.
20. No pass-outs or re-entry
Pass-outs and re-entry are not permitted unless the Promoter expressly announces otherwise.
A Ticket will generally be treated as used once the Ticket Holder has entered the Event Site. A person who leaves without authorised re-entry approval may be refused re-entry.
Ticket Holders should bring all permitted items they reasonably require for the Event because the Venue does not provide lockers or bag storage.
21. Venue conditions and dress standards
The conditions of entry and dress standards of Eatons Hill Hotel apply while a Ticket Holder is on Venue property.
Ticket Holders must wear safe and appropriate clothing and footwear. For outdoor areas, flat and comfortable footwear is strongly recommended because surfaces may be grassed, uneven, wet or slippery.
The Venue may refuse entry for clothing, footwear, symbols or presentation it reasonably considers unsafe, offensive, threatening or inconsistent with its published dress standards, subject to applicable law and any Event-specific guidance.
Ticket Holders should check the Venue’s current conditions of entry before attending.
22. Conduct, refusal of entry and removal
The Promoter and Venue may refuse entry or remove a person on reasonable grounds, including where the person:
does not hold a valid Ticket or meet the Event’s age or identification requirements;
appears intoxicated or affected by drugs;
behaves violently, aggressively, offensively, unlawfully, dangerously or in a way likely to cause nuisance, injury or damage;
harasses, threatens, intimidates or discriminates against another person;
possesses a prohibited item or enters a restricted area;
damages property, throws objects, starts a fire or interferes with performers, staff or production equipment;
trespasses or assists another person to trespass;
refuses a reasonable direction or security screening; or
breaches these terms, Flicket’s terms or the Venue’s conditions.
A removed person will not be re-admitted. Except where required by law, no refund is payable where refusal or removal results from that person’s conduct or breach.
23. Crowd safety and restricted activities
Ticket Holders must not crowd surf, stage dive, mosh in a dangerous manner, climb barriers or structures, enter the stage or production areas, throw objects, obstruct emergency routes or interfere with the safe movement of the crowd.
Event Staff may direct patrons to move, stop an activity, leave an area or change position to manage crowd density, emergency access, production requirements or safety.
General admission, standing and grassed areas do not guarantee a particular position, view or distance from a stage.
24. Alcohol, drugs, smoking and vaping
The Venue is licensed. Alcohol may only be purchased from authorised outlets and consumed in permitted areas.
Outside alcohol is prohibited. A person who brings alcohol into the Event Site may be refused entry or removed.
Only persons aged 18 or older with acceptable identification may purchase or consume alcohol. Supplying alcohol to a minor is prohibited and may result in removal and referral to police.
Service of alcohol may be refused at any time under responsible service of alcohol obligations.
The possession, use, supply or sale of illegal drugs is prohibited and may result in refusal, removal and referral to police.
Smoking and vaping are permitted only in designated smoking areas.
25. Food, beverages, water and medical items
Outside food and beverages are prohibited because the Venue is fully catered and licensed.
Sealed commercially bottled water may be brought into the Event Site unless an Event-specific safety direction states otherwise. Water and non-alcoholic drinks will also be available for purchase.
A sealed drink required for a dietary or health reason may be permitted where supported by written confirmation from a health professional and presented for inspection.
Medication for personal medical use is permitted. It should remain in its original packaging where reasonably practicable. A Ticket Holder may be asked to provide reasonable verification where the medication or associated equipment may otherwise appear prohibited.
A Ticket Holder with a medical, dietary or accessibility requirement should contact Flicket or the Promoter before the Event where an exception or special arrangement may be required.
26. Accessibility and companion tickets
The Promoter and Venue will take reasonable steps to provide accessible entry and facilities.
Accessible parking, toilets and access arrangements are subject to Venue availability and Event operations.
Companion Cards are accepted for eligible general admission tickets, but the companion must obtain a companion Ticket through Flicket before the Event. Presentation of a Companion Card alone does not guarantee admission without a Ticket.
Ticket Holders requiring accessible arrangements, wheelchair access, a medical chair or another reasonable adjustment should contact Flicket or the Venue in advance.
Access to a particular viewing platform or area may be subject to capacity and safety requirements.
27. Animals and assistance animals
Animals are not permitted at the Event Site except assistance animals permitted by applicable law.
A person attending with an assistance animal should contact the Promoter or Venue in advance where reasonably practicable so that safe access arrangements can be made.
An assistance animal must remain under effective control and must not create a genuine safety risk.
28. Photography, filming and recording by patrons
Personal mobile phones and small point-and-shoot cameras are permitted unless the Promoter or an artist directs otherwise.
Professional photography, detachable-lens cameras, commercial filming, livestreaming and audio or video recording are prohibited without written media accreditation.
Images and recordings made by a patron must be for private, non-commercial use and must not be sold, licensed, monetised or used to imply endorsement by the Event, Promoter or an artist.
Event Staff may direct a person to stop unauthorised photography or recording, secure equipment or leave the Event Site. Failure to comply may result in removal.
Nothing in these terms authorises Event Staff to access or delete data from a personal device without consent or lawful authority.
29. Official photography and recording
The Event may be photographed, filmed, livestreamed and audio recorded by the Promoter, Venue, artists, media partners and authorised contractors.
By entering the Event Site, a Ticket Holder acknowledges that their image, voice and likeness may be incidentally captured in crowd and Event recordings.
To the extent permitted by law, those recordings may be used in any media for reporting, archival, security, advertising, marketing and promotional purposes without further payment.
A person with a particular privacy or safety concern should speak with Event Staff as early as possible. The Promoter will consider reasonable requests but cannot guarantee exclusion from all crowd footage.
30. Capacities, seating, sightlines and access
Stages, bars, rooms, viewing areas, activations and other parts of the Event Site may have restricted capacities. Entry may be paused or refused once an area reaches capacity.
A Ticket provides admission to the Event generally and does not guarantee admission to every area, a particular sightline, uninterrupted viewing, seating or proximity to a performer.
Unless a Ticket expressly includes a reserved seat, general admission areas may be standing room only and positions are not reserved.
Temporary closures, queues and access restrictions may be imposed for safety, licensing, artist movement or operational reasons.
31. Weather and outdoor conditions
The Event may proceed in rain, heat, wind or other adverse weather unless the Promoter, Venue, emergency services or a relevant authority determines that it is unsafe or impractical to continue.
A Ticket Holder is not entitled to a refund merely because they choose not to attend due to weather where the Event proceeds substantially as advertised.
Umbrellas are prohibited. Ticket Holders should monitor the forecast and bring permitted weather protection such as a raincoat or poncho, sunscreen and suitable footwear.
The Event Site may contain grass, slopes, uneven surfaces, wet areas and limited shade. Ticket Holders must use reasonable care and follow designated paths and Event Staff directions.
The Promoter may delay, suspend, shorten, relocate or cancel a performance where reasonably necessary for safety. Any refund rights will be determined under clauses 13 to 15 and applicable law.
32. Health, noise and medical assistance
Live music may be loud and exposure may cause temporary or permanent hearing damage. Ticket Holders should use hearing protection where appropriate, particularly for children and persons sensitive to noise.
Ticket Holders must take reasonable care of their own health, remain hydrated and seek assistance promptly if they feel unwell or observe a safety concern.
Event Staff may arrange first aid, ambulance transport or emergency treatment reasonably considered necessary. The Ticket Holder is responsible for medical and ambulance costs lawfully incurred on their behalf, subject to insurance or statutory entitlements.
Ticket Holders must comply with any lawful public health or safety measure in effect at the time of the Event.
33. Personal property and lost property
Ticket Holders are responsible for their personal property. The Promoter and Venue are not responsible for lost, stolen, damaged or unattended property to the extent permitted by law.
There are no lockers or bag storage facilities at the Event.
Property found and handed to the Venue may be retained for approximately one month and then handled or disposed of under the Venue’s procedures.
A person seeking lost property should contact Eatons Hill Hotel and provide a detailed description.
34. Transport, parking and accommodation
Ticket Holders are responsible for planning transport and allowing sufficient time for queues, traffic, security screening and entry.
On-site parking is limited and is not guaranteed. Accessible parking is subject to availability and a valid permit.
Camping or sleeping overnight at the Venue or in the car park is prohibited.
The Promoter, Flicket and Venue are not responsible for public transport changes, rideshare availability, traffic, parking, accommodation or other third-party travel arrangements, except where required by law.
35. Personal information and communications
Personal information collected in connection with ticket purchases and Event attendance may be handled by Flicket, the Promoter, the Venue, payment providers and authorised service providers.
Personal information may be used to process and administer Tickets, verify Ticket Holders, prevent fraud, operate and secure the Event, provide customer support, communicate Event updates, process refunds, comply with law and send marketing where consent has been given or marketing is otherwise permitted by law.
Payment card information is processed by Flicket and its payment providers under their applicable terms and privacy policies. The Promoter does not ordinarily receive full payment card details.
Information may be processed or stored in Australia, New Zealand or another location disclosed in the relevant privacy policy.
By providing another attendee’s information, the purchaser confirms they are authorised to do so and will inform that person of the relevant privacy handling.
Official notices may be sent electronically to the purchaser’s nominated email address or mobile number and may also be published through official Event channels.
Marketing recipients may unsubscribe using the method included in the communication.
36. Event and website intellectual property
The names, logos, artwork, designs, photographs, video, audio, website content, maps, schedules and other material associated with AFROSOUL, the Promoter and the Event are protected by intellectual property laws.
Except for personal, non-commercial use, a person must not reproduce, distribute, modify, publish, sell, exploit or use Event material or branding without prior written permission.
Nothing in a Ticket grants a sponsorship, merchandising, broadcast, recording or other commercial right.
Unauthorised commercial association with the Event, artists, Promoter, Flicket or Venue is prohibited.
37. Third-party websites, services and links
Official Event pages may link to third-party websites or services, including Flicket, the Venue, transport providers, accommodation providers and social media platforms.
Unless the Promoter expressly states otherwise, the Promoter does not control and is not responsible for the content, availability, accuracy, security, privacy practices or terms of a third-party service.
A transaction with a third party is subject to that third party’s terms. This clause does not limit rights under applicable law or the Promoter’s obligations for services it supplies.
38. Liability and Australian Consumer Law
Nothing in these terms excludes, restricts or modifies a consumer guarantee, statutory right or liability that cannot lawfully be excluded, including rights under the Australian Consumer Law.
To the extent permitted by law, the Promoter, Flicket, Venue and their respective officers, employees, contractors and agents are not liable for loss arising from:
a Ticket Holder’s unlawful, negligent, reckless or unsafe conduct;
failure to follow reasonable directions, published requirements or safety signage;
the purchase or use of a fraudulent, duplicated or unauthorised resale Ticket;
loss of or damage to personal property;
third-party travel, accommodation, transport, parking or other services; or
circumstances outside their reasonable control.
To the extent permitted by law, liability for indirect or consequential loss, loss of opportunity, loss of income and expenses not directly forming part of the Ticket purchase is excluded. This exclusion does not apply where such loss cannot lawfully be excluded.
39. Responsibility for damage and indemnity
A Ticket Holder is responsible for loss, damage, cost or injury caused by their deliberate, unlawful or negligent conduct.
To the extent permitted by law, a Ticket Holder indemnifies the Promoter and Venue against a third-party claim arising directly from that Ticket Holder’s deliberate, unlawful or negligent conduct or material breach of these terms.
This indemnity does not apply to the extent that loss was caused or contributed to by the negligence, unlawful conduct or breach of the party seeking the indemnity.
40. Complaints and reporting concerns
A Ticket Holder should report a safety, accessibility, service or conduct concern to Event Staff as soon as possible so that the Promoter or Venue has a reasonable opportunity to respond during the Event.
Ticketing enquiries, delivery issues and approved refund requests should be directed to Flicket.
A complaint made after the Event should include the purchaser’s name, order details and a clear description of the issue. Nothing in this clause limits statutory rights or mandatory complaint timeframes.
41. Changes to operational requirements
The terms applying to a ticket transaction are those in effect when the transaction was completed, subject to Event-specific information already incorporated into the transaction.
The Promoter may update reasonable operational, security, accessibility, safety or entry requirements before the Event where necessary to comply with law, a Venue requirement, a public authority direction or the Event safety plan.
An operational update will not retrospectively remove a right that cannot lawfully be excluded. Material updates will be communicated through official Event channels or directly to purchasers where reasonably practicable.
42. General provisions
If a provision of these terms is invalid or unenforceable, it will be read down or severed to the minimum extent necessary and the remaining provisions will continue.
A failure or delay by the Promoter to enforce a provision is not a waiver of that provision or any other right.
The Promoter may assign or transfer its rights and obligations in connection with the Event to a related entity, co-promoter or replacement promoter, provided this does not reduce mandatory consumer rights.
Headings are for convenience only and do not affect interpretation.
These terms are governed by the laws of Queensland, Australia. The parties submit to the jurisdiction of Queensland courts and tribunals, subject to any mandatory right to bring a claim elsewhere.
